Terms of Service

In short: use the site and hosted services fairly, keep your account secure, and pay for a paid plan while you use it. The services come as they are, liability is capped, and New Hampshire law applies. If we ever discontinue a hosted service, you get at least 90 days' notice and can export your data until then. This summary isn't part of the terms; the full terms below govern.

These terms are an agreement between you and Casazium (“we” or “us”). Casazium is a sole proprietorship located in Merrimack, New Hampshire, USA. By accessing or using this site, or by signing up for a hosted Casazium service (such as the License Console), you agree to them. If you don’t agree, please don’t use the site or the service.

Use of the Site

  • Don’t abuse, disrupt, or attempt to breach security of the site or services.
  • Don’t scrape content at scale or use automated means without permission.

Accounts & Services

If a feature requires an account, you’re responsible for safeguarding credentials and for activity under your account.

Hosted Services (e.g. License Console)

Some Casazium products are offered as a hosted, managed service rather than software you run yourself. These additional terms apply to any hosted account:

  • You’re responsible for the accuracy of data you submit through a hosted service, including any records (e.g. license records) you create on behalf of your own customers.
  • You may only use a hosted service’s API to issue, manage, or verify licenses (or the equivalent activity for that product) — not to attempt unauthorized access to other accounts, probe for vulnerabilities, or exceed documented rate limits by evasive means.
  • A hosted service is provided on a best-effort basis: we do not commit to an uptime SLA, and features and plan limits may change with notice on this site. Changes to the price of a paid plan are covered under Paid Plans and Billing below.
  • We may suspend or terminate a hosted account for abuse, non-payment, or a material breach of these terms. On termination, we’ll make a reasonable effort to notify you and allow a window to export your data before deletion, except where immediate suspension is necessary to protect the service or other accounts.
  • You can export your hosted account’s data (every license and activation it owns, and its billing status) at any time from the console’s Settings page, with no support request, no waiting period, and no charge. You can also delete the account from the same page, or email us to request either — see Contact below. See our Privacy Policy for how we handle that data.

If We Discontinue a Hosted Service

If we decide to stop offering a hosted service, we’ll give you at least 90 days’ written notice, by email to the address on your account, before it shuts down. Until the shutdown date, the service keeps running and you can export your data as described above. After that date, your account and its data are deleted as described in our Privacy Policy. If you’ve paid in advance for time after the shutdown date, we’ll refund the unused portion.

This is separate from suspending or terminating an individual account for the reasons listed above, and from changes to features or plan limits.

Paid Plans and Billing

These terms apply if you subscribe to a paid hosted plan, such as Hosted — Pro.

  • Billing and renewal: paid plans are billed in advance, monthly or annually, through our payment processor, Stripe. Your subscription renews automatically at the end of each billing period, at the price then in effect, until you cancel.
  • Cancellation: you can cancel at any time from the billing page in the console. Cancellation takes effect at the end of your current billing period: you keep your paid plan's limits until then and won't be charged again. Your account then returns to the Free plan. Licenses you've already issued keep working, but if you have more active licenses than the Free plan allows, you can't issue new ones until you're back under its limit.
  • Refunds: payments are non-refundable, and we don't give refunds or credits for partial billing periods, except where the law requires otherwise, with two exceptions. First, you can request a full refund of your first annual payment for a plan by emailing us (see Contact below) within 14 days of that payment; a refunded subscription ends immediately and your account returns to the Free plan. Second, if we discontinue a hosted service, we refund time you've paid for after its shutdown date (see If We Discontinue a Hosted Service below).
  • Failed payments: if a payment fails, Stripe will retry it. Until it's paid, you can't issue new licenses, but licenses you've already issued keep working for verification and activation. If it still isn't paid, your subscription may be canceled and your account returned to the Free plan.
  • Price changes: we'll email you at least 30 days before any change to your plan's price. The new price applies from your first renewal after that notice, and you can cancel before then.
  • Taxes: prices don't include taxes. You're responsible for any sales, use, value-added, or similar taxes that apply to your purchase.
  • Deleting your account: deleting your hosted account ends any subscription immediately. It doesn't entitle you to a refund for the rest of the billing period, except as described under Refunds.

Your Data and Backups

You’re responsible for maintaining your own backups of any data you store in or export from a hosted service. We take reasonable care with that data, but we are not responsible for its loss, corruption, or unavailability, however caused.

Compliance with Laws

You’re responsible for complying with all laws and regulations that apply to your use of the site and any hosted service, including in the licenses and other records you issue to your own customers.

Intellectual Property

Content on this site is owned by Casazium unless otherwise noted. Don’t reuse it without permission unless a specific license is provided.

Disclaimers

The site and any hosted services are provided “as is” and “as available,” without warranties of any kind, express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We don’t guarantee uninterrupted, secure, or error-free operation.

Limitation of Liability

To the fullest extent permitted by law, Casazium isn’t liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, even if we’ve been advised of the possibility of them.

In no event shall Casazium’s total aggregate liability arising out of or relating to these terms, the site, or any hosted service exceed the greater of (a) the fees you paid (or would have paid) to Casazium in the twelve (12) months preceding the event giving rise to the claim, or (b) one hundred U.S. dollars (US $100). This cap applies even if you haven’t paid us anything — for example, while using a free tier.

Indemnification

You agree to indemnify and hold harmless Casazium and its owners, officers, and employees from any claims, damages, or expenses (including reasonable attorneys’ fees) arising from your use of the site or any hosted service, the content or records you submit or issue through it, or your breach of these terms.

Events Outside Our Control

We aren’t responsible for any delay or failure to perform caused by events beyond our reasonable control, including outages or failures of hosting, network, or other third-party providers, as well as natural disasters, labor disputes, or acts of government.

Governing Law and Venue

These terms are governed by the laws of the State of New Hampshire, without regard to conflict-of-law principles. Any dispute arising out of or relating to these terms, the site, or any hosted service shall be resolved exclusively in the state or federal courts located in Hillsborough County, New Hampshire, and you consent to the jurisdiction of those courts.

General

These terms do not create third-party beneficiary rights in any person other than the parties to them — including your own customers or end users. If any provision of these terms is held unenforceable, the remaining provisions stay in full force and effect.

Changes

We may update these terms from time to time. If you continue to use the site or a hosted service after changes take effect, you accept the revised terms.
